During a recent legislative session, County Councilman. James Winn, felt compelled to proselytize for political purposes, thus violating the establishment clause of the 1st Amendment. He went so far as to say that his brand of religion is the “only way” and that those who believe differently are in need of his prayers. Although the courts have determined that invocations are acceptable during government meetings, provided that they do not endorse a single religion, Mr. Winn clearly crossed this line. By doing so, he has exposed the County to expensive lawsuits, which will undoubtedly be forthcoming. Former County Council attorney, Robert Taylor, provides legal analysis of Mr. Winn's egregious error and explains the likely consequences.
