On the Friday, Oct. 17 edition of OPEN AGENDA, we delve more deeply into the issue of County Council members proselytizing and leading sectarian prayers during official legislative sessions. Following Councilman James Winn's evangelizing during a recent Council meeting and declaring that his brand of faith was the “only way,” the FREEDOM FROM RELIGION FOUNDATION has become involved, and a lawsuit against the Council may be forthcoming. Former County Council attorney, Robert Taylor, walks us through the specific case law interpreting the 1st Amendment's admonition that, “Congress shall pass no law respecting an establishment of religion...” and explains how it applies to local governments. Based on judicial precedent, it appears that the wall of separation between church and state has been violated and county taxpayers may wind up paying the price.
